1. Acceptance of Terms

By accessing or using the tools available at app.hofs.sg (the “Platform”), you agree to be bound by these Terms of Use and Disclaimer in their entirety. If you do not agree to any part of these terms, please do not use the Platform. These terms apply to all visitors and users without exception.

2. Nature of the Tools

The Platform provides digital tools based on traditional Chinese metaphysical systems, including BaZi (八字) destiny analysis, the Chinese Daily Almanac (通勝), and Feng Shui compass overlays. These tools are provided strictly for informational, educational, and personal entertainment purposes only.

The outputs generated by these tools — including but not limited to BaZi charts, luck pillar analyses, almanac recommendations, and Feng Shui directional readings — are derived from classical Chinese calendar calculations and established metaphysical traditions. They are presented as cultural and traditional reference material and should be understood in that context.

3. Not Professional Advice

Nothing on this Platform constitutes, or should be construed as, professional advice of any kind, including without limitation:

• Legal advice or guidance
• Financial, investment, or business advice
• Medical, psychiatric, or health advice
• Psychological counselling
• Spiritual or religious guidance

You should not make any significant life, financial, health, or legal decisions based solely on the outputs of these tools. For decisions of consequence, you are strongly encouraged to consult a qualified and licensed professional in the relevant field.

4. No Warranty on Accuracy

Whilst HOFS Pte Ltd endeavours to ensure that the calculations produced by the Platform are consistent with established traditional Chinese calendar systems, no representation or warranty — express or implied — is made as to the accuracy, completeness, reliability, or fitness for any particular purpose of the outputs.

Traditional metaphysical systems are interpretive in nature. Results may vary depending on the school of thought, interpretation method, or practitioner. The Platform applies one computational approach and does not claim to represent all traditions or schools.

5. Data Processing, Privacy, and User Indemnity

The Platform is designed and operates on a strictly client-side basis. All data entered by you — including without limitation personal names, dates and times of birth, residential addresses, and property floor plan schematics — is processed entirely within your own web browser on your device. No such data is transmitted to, received by, or stored on any server operated by HOFS Pte Ltd or any third party. No database, cloud storage, or server-side logging of user-submitted information exists or is employed by the Platform.

Where the Platform generates a shareable link (for example, a BaZi chart URL), any personal data included therein is encoded within that URL itself. Such a link is generated and held exclusively on your device. HOFS has no access to, and assumes no responsibility for, the contents of any link you choose to generate, store, copy, or share with any other person or platform.

The Platform uses Google Tag Manager (“GTM”) to collect anonymised usage analytics. This data is strictly limited to interaction events — such as when a tool is used or a chart is generated — and does not include any personal information entered into the tools (including names, dates of birth, contact details, or floor plan images). No personal data entered through the Platform is transmitted to Google or any other third party via analytics. Analytics data is processed by Google LLC in accordance with Google’s Privacy Policy (policies.google.com/privacy). You may opt out of analytics collection at any time by enabling the “Do Not Track” setting in your browser or by installing the Google Analytics Opt-out Browser Add-on.

Beyond anonymised analytics, no personal data submitted through the Platform is shared with, sold to, or otherwise disclosed to any third party, advertising network, or external platform.

By entering any personal or sensitive information into the Platform, you acknowledge and accept that you do so voluntarily and entirely at your own risk. You agree to indemnify, defend, and hold harmless HOFS Pte Ltd and its directors, officers, employees, consultants, and agents from and against any and all claims, losses, liabilities, damages, costs, and expenses (including legal fees) arising out of or relating to any unauthorised disclosure, interception, or exposure of data that occurs outside the Platform’s systems — including, without limitation, through device compromise, network interception, or your own sharing of generated URLs or outputs.

You are solely responsible for exercising appropriate caution in determining what information you choose to enter and with whom you share any outputs generated by the Platform.

6. Ownership of Generated Content and Permitted Use

All outputs generated by the Platform — including BaZi charts, luck pillar analyses, almanac recommendations, Feng Shui compass readings, and any other content produced through the tools (collectively, “Generated Content”) — are the exclusive intellectual property of HOFS Pte Ltd. The computational methodologies, interpretive frameworks, presentation formats, and underlying logic from which Generated Content is derived constitute proprietary works of HOFS Pte Ltd.

Generated Content is licensed to you for personal, non-commercial use only. You may not reproduce, republish, redistribute, sublicense, sell, display publicly, incorporate into any commercial product or service, or otherwise exploit Generated Content for any purpose beyond personal reference without the prior written consent of HOFS Pte Ltd.

Any use of Generated Content beyond the personal scope described above — including use by any third party, organisation, or commercial entity — is strictly prohibited. If you wish to use Generated Content for any purpose other than personal reference, or if you have any doubt as to whether your intended use falls within the permitted scope, you must contact HOFS Pte Ltd for prior written authorisation at: ken@hofs.sg.

7. Limitation of Liability

To the fullest extent permitted by applicable law, HOFS Pte Ltd, its directors, officers, employees, consultants, and agents (collectively, “HOFS”) shall not be liable for any loss, damage, or harm of any kind arising from or in connection with your use of, or reliance on, any information, tool, or output provided on this Platform, including without limitation:

• Financial loss or loss of profits
• Business or commercial losses
• Loss of data or information
• Indirect, consequential, special, or incidental damages
• Decisions made in reliance on the Platform’s outputs
• Any exposure, disclosure, or misuse of personal data arising from your use or sharing of generated URLs or outputs
• Any misrepresentation, whether innocent, negligent, or otherwise, arising from the nature of traditional metaphysical interpretation

This limitation applies regardless of whether HOFS was advised of the possibility of such losses.

8. User Responsibility

You acknowledge that your use of the Platform and any reliance on its outputs is entirely at your own risk. You assume full responsibility for any decisions or actions taken based on information obtained through the Platform, and for any personal or sensitive information you choose to submit to or share via the Platform.

9. Intellectual Property — Platform

All content on this Platform other than Generated Content — including software, design, text, graphics, and user interface elements — is the intellectual property of HOFS Pte Ltd unless otherwise stated. The traditional Chinese metaphysical systems and classical texts upon which the tools are based are part of the public cultural heritage of Chinese civilisation and are not claimed as proprietary by HOFS Pte Ltd.

10. External Links

The Platform may contain links to external websites, including hofs.sg. HOFS is not responsible for the content, accuracy, or practices of any third-party website and the inclusion of a link does not constitute an endorsement.

11. Governing Law

These Terms of Use and Disclaimer are governed by and construed in accordance with the laws of the Republic of Singapore. Any dispute arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Singapore.

12. Changes to These Terms

HOFS reserves the right to update or modify these terms at any time without prior notice. Continued use of the Platform following any such changes constitutes your acceptance of the revised terms. You are encouraged to review these terms periodically.
